On Wednesday, the Supreme Court ordered to examine the operation of the e-prisons portal built by the Union Home Ministry and NIC on October 3.
A bench led by Justice Abhay Oka asked the top court’s Registrar Judicial to ensure that the portal’s functionality is shown to the court in the conference room on the specified day.
The court stated that the central government’s counsel and other parties would be welcome to attend. The court further directed the Registry to guarantee that NIC’s representative is likewise present.
The court issued the judgment while reviewing an aspect of the e-prisons site in a dispute involving the policy for granting bail by courts.
This was after the court was told by the amicus that the e-prison portal is a prison management portal run by the Home Ministry and connects many prisons across the country, and has the records of all the inmates.
The court, however, observed that it would like to see how the portal works first before moving forward since it’s unable to understand without clearly looking at the portal. The amicus curiae in the case told the court that the e-prison portal is a data mine, working at different stages.
“What is the practical utility? In bail matters we want to know how much a person has undergone and have to ask for that data,” the court said.
The court further stated that it has come across cases from different courts where no one is aware of the bail order being passed and a person isn’t produced before the trial court for the formalities.
“We can pass further orders ensuring that persons are taken to the trial court to complete the bail formalities,” the court orally remarked.
The court will consider the aspect of the e-prison portal again on 5th November. The court stated that After seeing the demonstration of the portal it would hear the amicus on the note submitted by him.
