Supreme Court Slams MP High Court

The Supreme Court of India slammed the Madhya Pradesh High Court over the termination of women judges. Criticising the criteria for dismissal, the Apex Court noted that men would have understood the situation if they “menstruated”.

The top court slammed the Madhya Pradesh High Court for the manner in which it terminated the services of women civil judges in the State and refused to reinstate some of them.

The Supreme Court Bench of BV Nagarathna and N Kotiswar Singh said that case disposal rate cannot be a yardstick when the judges were suffering mentally and physically.

“It is very easy to say ‘dismissed-dismissed’ and go home. Even we are hearing this matter at length; can lawyers say we are slow? Particularly for women, if they are suffering physically and mentally, do not say they are slow and send them home. Let there be same criteria for male judges and judicial officers, we will see then, and we know what happens. How can you have target units (of case disposal) for district judiciary?” Justice Nagarathna remarked.

“I wish men had menstruation, then only they would understand,” said the judge. The matter would be next heard on December 12.

The Supreme Court, in January, had taken suo motu cognisance of the termination of the six judges by the Madhya Pradesh government in June 2023. In February, the Apex Court had orally asked the High Court whether it was willing to reconsider its decision.

The law department issued the termination orders after an administrative committee and a full-court meeting of High Court justices determined that their performance during the probation period was unacceptable.
