SC Issues Notice to Rajya Sabha Secretariat in Raghav Chadha’s Suspension Case

On Monday, the Supreme Court sent a notice to the Rajya Sabha secretariat in response to a petition filed by Raghav Chadha of the Aam Aadmi Party, challenging his indefinite suspension from the Upper House while the privileges committee looked into the matter.

The Supreme Court has requested the help of the Attorney General, with the next hearing scheduled for October 30. On October 10, Chadha filed a petition with the Supreme Court to contest his expulsion from the House.

Due to allegations that he failed to obtain the agreement of five Rajya Sabha MPs before adding their consent to a select committee, he was suspended during the Monsoon session. The suspension will stay in effect until the privileges committee investigates the case against him publishes its report.

Five Rajya Sabha members, including S Phangnon Konyak of the BJP, Narhari Amin and Sudhanshu Trivedi of the AIADMK, and Sasmit Patra of the BJD, claimed that their identities were included in a select committee to consider the Government of National Capital Territory of Delhi (Amendment) Bill, 2023 without their permission.

The divisive measure, which replaced the ordinance governing the transfer and posting of senior officials in the Delhi government, was approved by both chambers of parliament during the monsoon session. On August 13, the President gave his approval to the legislation.

Piyush Goyal, a union minister, accused Chadha of engaging in “gross impropriety and misconduct” on numerous occasions, claiming that the MP’s actions “far depart from the ethical standards expected of a member of this august house.”

On his suspension, Raghav Chadha had said, “My suspension serves as a stark message from the BJP to today’s youth: If you dare to ask questions, we will crush your voice. I was suspended for asking tough questions that left the BJP, the world’s largest party, without answers through my speech in Parliament on Delhi Services Bill”.

“My crime was exposing BJP’s double standards on Delhi’s statehood and asking them to follow ‘Advani-vaad’ and ‘Vajpayee-vad’”, Chadha added.
