Nadda allegedly stated during an election rally on May 7 in the Vijayanagara district’s Harappanahalli town that voters would lose access to Central government programmes if the BJP lost. The speech was deemed to have breached the model code, according to representatives of the Election Vigilance Division, who filed a complaint with the Harappanahalli Police Station.
Justice M. Nagaprasanna reportedly stated that the complaint appeared to have been brought with malice. The case does not claim that the petitioner interfered with anyone’s ability to vote freely, the court said. Additionally, it says nothing about the petitioner being charged with election-related personation as defined by Section 171D of the IPC. The FIR is ineligible to be filed under 171F, the judge further declared.
The fundamental prerequisite for an incident to be considered an infraction under Section 171F is stating that the complaint of the components of undue influence or personation. The petitioner is accused of endangering voters while speaking at a public event on May 7, 2023, in violation of the Election Code of Conduct. That it would harm ambiguity itself turns out to be a rather nebulous complaint. According to the court, “the crime is only hanging on the petitioner projecting it to be an infraction on such a vague allegation which is made carelessly against the petitioner.
