Central Govt. Clears Bill to Replace Delhi Ordinance, Granting Control Over Officer Posting

According to reports, the national cabinet today approved a measure to amend the ordinance allowing the center to take control over officer posting from the Delhi government. According to them, the law would shortly be tabled in the parliament.

One of the most recent grounds of contention between the BJP and the Delhi government of Arvind Kejriwal was the ordinance. The Supreme Court has heard an appeal from the AAP administration, which is supported by the Congress and other Opposition parties.

When the parliament is not in session, the government may introduce an ordinance, but it must be approved by the legislature within six weeks of the assembly.

Although the Monsoon Session of Parliament is presently in session, it is unclear when the administration intends to propose the measure.

For the transfer of Group, officers from the Delhi, Andaman and Nicobar, Lakshadweep, Daman and Diu, and Dadra and Nagar Haveli (Civil) Services (DANICS) cadre, the order aims to establish a National Capital Civil Service Authority. Additionally, it would provide the body the authority to punish them through disciplinary measures.

The AAP asserts that the ordinance disregarded the Supreme Court’s decision in favour of the state government.

On May 11, the Supreme Court decided the power struggle matter, stating that the Delhi government must have control over services and that the Lieutenant Governor is bound by its ruling. The judges dissented from the claim that the Delhi government had no control over services, stating instead that only Public Order, Police, and Land were outside of its jurisdiction.
