Naresh Balyan, an Aam Aadmi Party MLA, was detained by Delhi Police on Wednesday in connection with a case under Maharashtra’s rigorous Control of Organized Crime Act.
Balyan was already in police detention in connection with a second suspected extortion case when he was arrested.
The arrest occurred shortly after Balyan was granted bail by a Delhi judge in the extortion case.
The arrest came after the police dismissed a motion to the court to hold Balyan under MCOCA. The application was found “not maintainable” by Additional Chief Metropolitan Magistrate Paras Dalal.
In a separate development earlier in the day, Balyan was granted bail by the same court in the extortion case. He was released on a personal bond of Rs 50,000 and one surety of the same amount.
The extortion case proceedings saw the police inform the court that Balyan was no longer needed for custodial interrogation, and they requested his judicial custody for 14 days.
After Balyan was granted bail, his counsel raised apprehensions about his arrest in the MCOCA case.
To this, the court said, “I’m not saying anything. They can interrogate and arrest as per law. He’s free to go now. Whichever agency wants to hold him back, they can as per law. I’ve accepted bail bonds, he’s no more in my custody’.”
Organized crime, as defined under MCOCA, is a non-bailable offence, meaning the accused must seek bail directly from the court.Â
